Terms of Service

Effective date: 22 October 2026

PLEASE READ SECTION 18 CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES BY BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. YOU CAN OPT OUT WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS.

The short version. This summary is here to help; the full terms below are what apply.

  • FlipSift searches public marketplace listings and tells you about the ones that match what you’re looking for. We don’t sell anything on those marketplaces, and we aren’t part of any deal you make with a seller.
  • Subscriptions renew automatically until you cancel. Cancelling stops future billing; you keep access until the end of the period you’ve paid for.
  • We don’t give refunds, except for billing errors and the other cases listed in the Refund & Cancellation Policy. If we permanently take away a marketplace or main feature of your plan, you can cancel and get back the unused part of what you paid.
  • Estimated profits, sold prices and the AI’s product suggestions are estimates and can be wrong. Check the listing yourself before you buy.
  • We can’t promise you’ll find deals or make a profit, and marketplaces can change or block access without warning.

1. The agreement

These Terms of Service (“Terms”) are an agreement between you and FlipSift (“FlipSift”, “we”, “us”, “our”). They cover the FlipSift website, dashboard, alert emails, Discord alerts, API and anything else we provide as part of the service (together, the “Service”).

By subscribing, creating an account, or using the Service, you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy, which form part of these Terms. If you don’t agree, don’t use the Service.

If you use the Service on behalf of a business, you agree to these Terms for that business and confirm you have authority to do so; “you” then means the business as well as you.

2. What the Service does

FlipSift lets you set up monitors: saved searches for items you want to buy, with a location, a price range and optional keywords. On a schedule set by your plan, we search publicly available listings on third-party marketplaces — currently Facebook Marketplace, OfferUp and Craigslist, with eBay on some plans — and tell you about listings that match, by email, on your dashboard and, where your plan includes it, in a Discord channel you connect.

The Service is an information tool. We do not buy or sell items, we are not an agent for any buyer or seller, we don’t contact sellers for you, and we don’t take part in, guarantee or handle payment for any transaction you make.

Which marketplaces, features and limits each plan includes is shown on our pricing page at the time you subscribe. We may improve, change or remove features over time. If we remove a feature that is a main part of the plan you are paying for, we’ll tell you in advance where we reasonably can, and you can cancel and get a refund of the unused part of the period you’ve paid for, monthly or yearly.

Features we label “beta”, “preview” or “early access” are still being tried out. They may be incomplete or unreliable, may change, and may be withdrawn at any time; they are provided as they are, and changing or withdrawing one is not a reason for a refund.

3. Who can use it

You must be at least 18 years old and able to form a binding contract where you live. The Service is offered only to users in the United States; it searches US marketplaces and is priced in US dollars. You may not use the Service if you are barred from doing so under applicable law, or if we have previously closed your account for breaking these Terms.

4. Your account and signing in

  • Sign in with Google. You sign in with your Google account; there is no FlipSift password. Anyone who can sign in to your Google account can sign in to yours, so keep your Google account secure (we recommend two-step verification). Our emails never contain a way into your account. Before changes such as where alerts go, we may ask you to sign in to Google again.
  • Linking a purchase. If you sign in with a Google account whose email differs from the one you bought with, we email a one-time confirmation to the purchase address; it works once, for 30 minutes, and only with the Google account that asked. Moving a purchase to a different Google account later needs our support, and we may ask you to prove who you are.
  • Accurate details. Give us an email address you control and keep it up to date. We send account notices and alerts there.
  • Seats. Plans that include team seats let you add teammates up to the plan’s number of seats: email us at flipsift@gmail.com with their email address and we add them. Each seat is for one named person. You are responsible for what happens under your account, including by your teammates.
  • Tell us about misuse. If you think someone else has accessed your account, email us at flipsift@gmail.com. We can sign out every device on your account.

5. Plans, billing and renewal

  • Payments. Payments are processed by Whop (whop.com), a third-party payment platform, and Whop’s own terms also apply to your purchase. We never see or store your full card details.
  • Free trial. New customers can start a 7-day free trial of a paid plan. A valid payment method is required, the trial has its own lower limits, and when it ends your plan starts and your card is charged unless you cancel before then. Trials are limited to one per person: we check your email address, payment account and card (see the Privacy Policy), and a repeat trial does not start.
  • Monitor slots. Plans include a number of marketplace monitor slots. One search on one marketplace uses one slot, so a search on three marketplaces uses three.
  • Automatic renewal. Subscriptions are monthly or yearly and renew automatically at the end of each period, at the then-current price for your plan, until you cancel. By subscribing you authorize us and our payment processor to charge your payment method at each renewal. On a yearly plan we email you a reminder before each renewal with the price and how to cancel.
  • Cancelling online. You can cancel online at any time, right away, from Billing & cancel on your dashboard (your Whop membership page), or by following our without signing in — no call or email needed.
  • Prices and taxes. Prices are shown on our pricing page and at checkout. Unless stated otherwise, prices are in US dollars and don’t include taxes, which may be added where required.
  • Price changes. We may change prices. We’ll email you at least 14 and no more than 30 days before a new price applies to your subscription, with the new price, the date it applies from (your first renewal on or after that date) and how to cancel. If you don’t want to pay the new price, cancel before that renewal.
  • Upgrades and downgrades. How a plan change is charged (for example, whether it is prorated) is shown by the payment processor at the time of the change. Downgrading may pause monitors that exceed the new plan’s limits and shorten how far back your history goes.
  • Failed payments. If a renewal payment fails, we may suspend alerts until it is resolved, and cancel the subscription if it isn’t.
  • Billing problems and chargebacks. If you think a charge is wrong, please email us first — billing errors are refunded (see the Refund & Cancellation Policy), and telling us within 30 days of the charge lets us fix it quickly. If you dispute a charge with your bank or card issuer without contacting us first, we may pause your account while the dispute is open. None of this limits any right you have under law to dispute a charge.

6. Cancelling

You can cancel at any time. Cancelling stops future billing; it does not refund payments already made. You keep access to your plan until the end of the billing period you’ve already paid for, and it is not renewed after that. Details of how to cancel are in the Refund & Cancellation Policy.

7. Refunds

Payments are non-refundable, except for billing errors and other valid reasons you raise with us, as set out in the Refund & Cancellation Policy. Nothing in these Terms takes away any refund or cancellation right you have under consumer law that can’t be excluded by contract.

8. Third-party marketplaces

  • Not affiliated. FlipSift is independent. It is not affiliated with, endorsed by or sponsored by Facebook or Meta, OfferUp, Craigslist, eBay, Google, Discord or any other marketplace or service it works with. Their names are used only to describe where listings come from and how the Service works.
  • We don’t control listings. Listings are written by sellers. We show what the marketplace showed at the time we searched, and we don’t check that listings are accurate, legal, genuine, still available or priced as stated. Items may be counterfeit, misdescribed, already sold, or scams.
  • Your deals are your own. Any contact, purchase, meeting or payment with a seller is solely between you and that seller, under the marketplace’s rules. We are not responsible for the item, the seller, or the outcome. Use the marketplace’s own safety guidance, and meet in safe, public places.
  • eBay listings. Some plans show listings from eBay through eBay’s developer program. When you view eBay content through FlipSift you agree to be bound by the eBay Developers Program API License Agreement as it applies to you; eBay Inc. is a third-party beneficiary of this section and may enforce it directly; and your access to eBay content through FlipSift may be revoked at any time.
  • Their terms apply to you. When you visit a marketplace, message a seller or buy something, you are using that marketplace, and its terms apply to what you do there. You are responsible for following them.
  • We never see every listing. Marketplaces show different results to different people, reorder and hide listings, and keep some visible only to signed-in users, so no search finds everything and some matching listings will be missed.
  • Access can change. Marketplaces can change their sites, limit or block automated access, or stop showing some listings at any time. That can make a source slower, incomplete or temporarily unavailable, and we may add or remove sources as a result. These are limits of how a service like ours works, not defects: a slow, incomplete or temporarily unavailable source is not a reason for a refund or credit, and we can’t promise to restore a source a marketplace has blocked. If a marketplace included in your plan becomes permanently unavailable, we’ll tell you; you can cancel, and we’ll refund the unused part of the period you’ve paid for, monthly or yearly.

9. No guarantee of deals or profit

We don’t promise that the Service will find any particular item, any number of deals, or deals in your area, or that you’ll be first to a listing. Any resale value, profit, return on investment or similar figure we show is an automated estimate based on limited data, and may be wrong. Profit, ROI and maximum-buy figures are calculated from the resale price, marketplace and shipping cost you enter, using the marketplace’s published fees as we last checked them; fees change, and your own fees (store subscriptions, promotions, account standing) may differ. On some plans an AI model suggests which product a listing is, from its title, price and photo. It is a guess, not a guarantee: it can misread a photo, miss a detail or name the wrong product, so always check the listing yourself before you buy. It is included up to a fair-use number of new listings a day, shown on each plan (150 on Pro, 450 on Power); listings already identified for anyone don’t count. Past the day’s limit your alerts still arrive on time, just without the AI line, and it resets at midnight UTC. Nothing in the Service is financial, investment, tax or legal advice. You alone decide what to buy and what to pay, and you bear the risk of every purchase and resale. You may pay for the Service and still not find anything worth buying, or not earn back what you paid for it.

How profit figures are worked out. An estimated profit is a resale price — either the one you enter on a monitor, or the median of recent eBay sales for the product — minus that marketplace’s published selling fees, the shipping cost you set (or a typical figure for the category) and the listing’s asking price. It leaves out sales tax you may owe, travel, your time, returns, items that don’t sell, and price changes. Results other people share (for example “wins” in a community space) are their own, often shared because they went well. They aren’t a promise or a guide to what you’ll make: that depends on what you buy, what you pay and what it sells for, and some flips lose money.

Sold prices on some plans are recent eBay sales for the product or search, collected by a third-party service. They are a guide to what similar items sold for, not a quote or a promise: they can include items in a different condition, with accessories or missing parts, or simply the wrong product, and prices move. When our source is unavailable we show the most recent prices we have, with their date.

10. Alerts and availability

  • Times we give for alerts (for example “within about 5 minutes”) describe how the Service normally works, not a guarantee. Alerts can be delayed or missed — for example because a marketplace is slow or blocking access, because of email or Discord delivery problems, or because of maintenance or outages.
  • A search that has found nothing new for a day is checked at most every 30 minutes, and at most hourly after a week, until something new appears — then it returns to your plan’s speed. Between 1 and 6 a.m. in the search’s local time, every search runs at half its usual speed. eBay is searched at most every 30 minutes on every plan.
  • Email can land in spam or be blocked by your provider. Check your dashboard, which shows every match your plan keeps, even when an email doesn’t arrive.
  • We work to keep the Service running but don’t offer an uptime guarantee or service-level agreement unless we’ve agreed one with you in writing.
  • The numbers in your plan (monitor slots, scan speeds, Facebook and eBay searches, AI identifications) are the most your plan allows, not a promise that every search runs that often. If an account’s use is unusually heavy and affects the Service for other customers, we may slow or pause some of its searches, and we’ll tell you if we do.
  • How long we keep your matches depends on your plan. Listings you save, mark as bought or mark as sold are kept for as long as your account exists. See the Privacy Policy.

11. Acceptable use

You agree not to:

  • use the Service for anything illegal, including buying or selling stolen, counterfeit, recalled or prohibited goods;
  • use listing information to harass, threaten, stalk, defraud or spam sellers or anyone else, or to send bulk or automated messages to sellers;
  • share your session, account or API keys with anyone who isn’t a seat on your plan, or resell, sublicense or share access to the Service;
  • republish, resell or redistribute the listings or data you get from the Service, other than for your own buying and reselling activity;
  • use bots or other automated tools to access or copy the Service, or use it to build a competing product;
  • get around plan limits, rate limits or access controls, or create several accounts to avoid them;
  • start more than one free trial, including by using different email addresses, payment accounts or cards;
  • access the Service with bots, scripts, headless browsers or AI agents, other than through the API on plans that include it;
  • probe, scan or test the security of the Service, interfere with it, overload it, or introduce malware — except with our written permission;
  • reverse engineer the Service except where the law allows it despite this restriction; or
  • use the Service in a way that could expose us or other customers to legal liability or harm.

12. Discord, API and integrations

  • Discord. If you connect a Discord webhook, we post alerts to that channel. Everyone who can see the channel can see them, so connect only a channel that only you and the seats on your plan can read: alerts are for your account, not for sharing with a wider server. Discord’s own terms apply to Discord. If Discord tells us the webhook no longer exists, we disconnect it.
  • API. On plans with API access, email us at flipsift@gmail.com and we create a key for your own use. Keep it secret; you are responsible for requests made with it. We may rate-limit, change or revoke API access to protect the Service, and we’ll try to give notice of breaking changes.

13. Your content and our content

  • Yours. Your monitor settings, notes, pipeline (saved, bought and sold items, prices you enter) and similar data are yours. You give us permission to store and process them to run the Service for you, as described in our Privacy Policy.
  • Ours. The Service itself — its software, design, text and branding — belongs to us or our licensors. While your subscription is active we give you a personal, non-exclusive, non-transferable right to use it under these Terms.
  • Listings. Listing text and images belong to the sellers or marketplaces that published them. We show them to you so you can find and evaluate items, and you may use them only for that.
  • Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
  • Copyright complaints (DMCA). Listing photos are shown directly from the marketplace’s own servers, and we don’t keep copies. If you believe something shown in the Service infringes your copyright, send our designated agent (FlipSift, flipsift@gmail.com) a notice under 17 U.S.C. § 512(c)(3) that includes: your physical or electronic signature; the work you say is infringed; the material and where it appears in the Service (for example the listing’s link); your address, phone number and email; a statement that you believe in good faith the use isn’t authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them. We remove or disable material that a valid notice identifies, and tell the person affected where we can.
  • Counter-notices. If something you posted was removed and you believe that was a mistake, you can send the agent a counter-notice with your signature, what was removed and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, and your name, address and phone number with your consent to the jurisdiction of the federal court for your address (or, outside the US, any district where we may be found) and to service from the person who complained. Unless they tell us within 10 to 14 business days that they have filed a lawsuit, we may restore it.
  • Repeat infringers. We close, in appropriate circumstances, the accounts of people who repeatedly infringe others’ rights.
  • Community spaces. If we run a community space (for example a Discord server), what you post there is yours, and you give us permission to show it there. Be civil; don’t post other people’s personal information, scams or spam; and don’t message members to sell them anything unless they ask — staff will never message you first asking for payment or your sign-in details. Staff and anyone we reward are labelled as such. You are free to post honest reviews of FlipSift anywhere, positive or negative.

14. Suspension and termination

  • You can stop using the Service and cancel at any time.
  • We may suspend or close your account if you seriously or repeatedly break these Terms, if you don’t pay, if we reasonably believe your use is fraudulent, puts the Service or other people at risk, or breaks the law, or if the law requires it. We’ll tell you why and give you a chance to fix it first, unless the problem is fraud, a security risk or harm to others, or the law stops us — then we may act first and tell you afterwards.
  • If you think we got it wrong, email us within 30 days of being told. A person will review it and reply within 3 business days, and if we were wrong we’ll restore your account.
  • If we close your account because you broke these Terms, you won’t get a refund. If we close it for any other reason, or stop offering the Service entirely, we’ll refund the unused part of the period you’ve paid for (and if we stop the Service, we’ll give you reasonable notice first).
  • Sections 8, 9 and 13 to 20 continue to apply after your account ends.

15. Disclaimers

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY LISTING INFORMATION IS ACCURATE OR COMPLETE. Some states don’t allow some of these exclusions, so they may not all apply to you.

16. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DEALS, LOST DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS;
  • WE ARE NOT LIABLE FOR ANY LOSS ARISING FROM A LISTING, A SELLER, A MARKETPLACE, OR ANY TRANSACTION YOU MAKE, INCLUDING ITEMS THAT ARE COUNTERFEIT, MISDESCRIBED, UNAVAILABLE OR NOT DELIVERED; AND
  • OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) US$50.

These limits don’t apply to liability for our fraud, gross negligence or willful misconduct, or to any liability that can’t be limited or excluded under applicable law, including consumer protection law that can’t be waived. Some states don’t allow the exclusion or limitation of incidental or consequential damages, so some of these limits may not apply to you.

17. Indemnity

To the extent the law allows, you agree to indemnify and hold us harmless from claims, losses and reasonable costs (including legal fees) brought by third parties to the extent they arise from your material breach of these Terms, your breaking the law or someone else’s rights, or a purchase, sale or other deal you make with a seller, buyer or marketplace — but not to the extent a claim is caused by our own breach, negligence or misconduct. We’ll tell you promptly about any such claim and let you take part in defending it.

18. Governing law, disputes and arbitration

These Terms are governed by the Federal Arbitration Act for this section, and otherwise by the laws of [governing law not yet set], without regard to its conflict-of-laws rules. Except where the law doesn’t allow it, a claim relating to the Service must be brought within two years of when it arose.

Arbitration and class-action waiver

  • Talk to us first. If you have a problem, please email us at flipsift@gmail.com with your name, the email on your account, and what you want us to do. Most issues are resolved quickly that way. You and we each agree to give the other 30 days to try to resolve a dispute informally before starting arbitration or a court case.
  • Individual arbitration. Any dispute between you and us arising out of or relating to the Service or these Terms that isn’t resolved informally will be decided by binding individual arbitration, not in court. The arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules, as in effect when the arbitration starts (adr.org). The arbitrator may award the same individual relief a court could. You and we each waive the right to a jury trial.
  • Small claims. Either of us may instead bring an individual claim in small claims court, as long as it stays there and is brought only on that party’s own behalf.
  • No class actions. You and we may bring claims against each other only individually, not as a plaintiff or class member in any class or collective proceeding, and the arbitrator may not combine more than one person’s claims or preside over any class or collective proceeding.
  • Fees. We pay all AAA filing, administration and arbitrator fees above the amount the AAA’s Consumer Arbitration Rules cap a consumer’s filing fees at.
  • Opting out. You can opt out of this arbitration agreement by emailing flipsift@gmail.com within 30 days of first accepting these Terms, saying that you opt out of arbitration and giving the email on your account. Opting out doesn’t affect any other part of these Terms.
  • If part of this is unenforceable. If the class and collective action waiver is found unenforceable for a claim, that claim (and only that claim) goes to court, and is paused until any arbitrable claims are decided. Nothing in this section waives your right to seek public injunctive relief in court; a request for public injunctive relief is decided by a court after any individual claims are arbitrated. Any claim not subject to arbitration will be decided by the state or federal courts of the place whose law governs these Terms, unless the law where you live gives you the right to bring it there.
  • Which disputes. This arbitration agreement applies only to disputes that arise after you first accept these Terms with it in them; earlier disputes are handled under the terms that applied when they arose.

19. Changes to these terms

We may update these Terms. We’ll change the effective date above, and for material changes we’ll email you at least 14 days before they take effect and ask you to agree to them when you next sign in. If you don’t agree, you can cancel at any time — including from our, without agreeing to anything new. A change applies only from its effective date: disputes that arose before it are handled under the Terms that applied when they arose.

20. General

  • These Terms, with the Privacy Policy and the Refund & Cancellation Policy, are the whole agreement between you and us about the Service. Nothing on our website, in our marketing or in a support conversation changes them unless we agree it with you in writing. The short version at the top and the section headings are there to help you read them; they don’t change what the sections say.
  • You agree that we can give you agreements, notices and other communications electronically — by email or on the website and dashboard — and that they count as being “in writing”.
  • You confirm you are not in a country under a US embargo and not on a US government list of restricted parties, and that you won’t use the Service in breach of export or sanctions laws.
  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • Nothing in these Terms limits any right you have under consumer protection law that cannot be waived.
  • If we don’t enforce a right immediately, we haven’t given it up.
  • You may not transfer your account or these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of the business, and we’ll tell you if we do.
  • We aren’t responsible for delays or failures caused by events outside our reasonable control, including marketplace changes or blocking, outages at our hosting, email or payment providers, and internet failures.
  • We may send you notices by email to the address on your account. You can send notices to us at the address below.
